NOTICE OF ELECTION AND MEASURE TO BE VOTED ON ORDINANCES OF THE CITY OF AVENAL ENACTING A ONE PERCENT (1.0% — ONE-CENT) GENERAL SALES TAX AND A CANNABIS BUSINESS TAX.

NOTICE IS HEREBY GIVEN that a general municipal election will be held in the City of Avenal on Tuesday, November 8, 2022, between the hours of 7:00 AM and 8:00 PM, to fill two full-term seats on the City Council and the following measures are to be voted on:

If this measure is approved, Ordinance No. 2022-04 of the City of Avenal (“City”) will add Chapter 5B to Title 3 of the Municipal Code of the City of Avenal, imposing a one (1) cent retail transactions and use tax (“sales tax”) upon all retailers within the incorporated territory of the City. The revenues will be deposited into the City’s general fund. The City Council would have authority to at any time suspend collection of all or a portion of the sales tax.

Avenal Continuation of Essential City Services Funding – MEASURE “A”
To preserve the safety and character of Avenal, and maintain essential general City services for Avenal residents including police, 911 emergency response, fire protection, disaster preparedness, recreational programs and facilities, park maintenance and improvements, street maintenance and repairs and other essential services, shall Ordinance No. 2022-04, imposing a 1-cent general sales and use tax, be adopted? Estimated revenues between $400,000 and $500,000 annually, indefinitely.

If this measure is approved, Ordinance No. 2022-04 of the City of Avenal (“City”) will add Chapter 5B to Title 3 of the Municipal Code of the City of Avenal, imposing a one (1) cent retail transactions and use tax (“sales tax”) upon all retailers within the incorporated territory of the City. The revenues will be deposited into the City’s general fund. The City Council would have authority to at any time suspend collection of all or a portion of the sales tax.

MEASURE - "C"
Shall Ordinance 2022-05 be adopted authorizing a commercial cannabis business tax in the City of Avenal on commercial cannabis businesses up to $25 per square foot (annually adjusted by CPI) or at 15% of gross receipts, to maintain essential public safety and general City services including, but not limited to, police, drug addiction and gang prevention, park maintenance, street maintenance for Avenal residents, generating undetermined revenue, potentially up to $400,000 to $600,000 annually until repealed?

If this measure is approved, Ordinance No. 2022-05 of the City will add Chapter 5C to Title 3 of the Municipal Code of the City of Avenal, imposing a cannabis business tax within the incorporated territory of the City. The revenues will be deposited into the City’s general fund. The City Council would have authority to at any time suspend collection of all or a portion of the sales tax. On June 23, 2022, the City Council approved the submittal of the ordinances to the voters of the City of Avenal, allowing the residents of Avenal to choose whether the sales tax and cannabis business tax should be adopted. If either of these measures are not approved by a majority vote of the votes cast on the measure in the election to be held on November 8, 2022, the City Council shall not adopt the respective ordinance(s) and the tax(es) will not be imposed.
